Residence and work permit, and performing other work
The regulations governing the possibility of a foreigner taking up a job in Poland are complicated. This is due, among others, to the number of exceptions from exception. Each time, the specific situation of the foreigner should be well analysed. Only after such an analysis it can be determined whether a foreigner can apply for a job in Poland and whether he needs a work permit.
This entry will address only two issues:
- whether a foreigner with a residence and work permit in company X may also take up another job (at a different position or in another company). If he can take another job, on what basis?
- whether a foreigner with a residence permit due to the business activity may take up a job. If so, on what basis?

Additional work
In each of the above cases, a foreigner may take up additional work. It can be work for another employer or a different position. A contract of employment or an order can be the basis for the performance of work. As a rule, a separate work permit will be needed to perform this additional work.
Work based on a declaration
In the case of some foreigners, during their stay in Poland based on the residence permits referred to above, they also have an additional option. It is about citizens of Armenia, Belarus, Georgia, Moldova, Russia and Ukraine. These foreigners can provide work for a Polish employer on the basis of a registered declaration of entrustment of work. The employer, before entrusting work, must register the declaration in the Poviat Labour Office. On this basis, work is allowed for 6 months within the next 12 months. The work which the foreigner will perform on this basis may not be seasonal work within the meaning of the provisions.
